James F. Gallagher, P.E., F.ASCE
James F. Gallagher, P.E., F.ASCE, a Principal with Resolution Management Consultants, Inc. (RMC), has over 35 years of hands-on experience in contract development, construction/project management and construction claims prevention and resolution. Licensed as a Professional Engineer in 16 states, Mr. Gallagher’s experience spans all types of construction services on projects involving the public sector, institutional, commercial, power, environmental, marine, educational, and transportation including highway/bridges, light rail and airports on behalf of owners/operators and government agencies to contractors, engineers, architects, attorneys, and vendors.
Mr. Gallagher has led and performed management and risk audits, development of project controls, and risk assessments of public and private projects. His construction experience encompasses contract preparation, field monitoring and inspection, construction scheduling development and updating, change order analysis, contract compliance audits, project close-out negotiations and claims analysis involving schedule delay, disruption and acceleration, cost impact and extra work; differing site conditions; cost estimating; budget assessments; termination and damage calculations. He is also proficient in computer scheduling, spreadsheet and database programs used in program management and claims analysis efforts, and the development of electronic document management/litigation support systems.
Dispute avoidance and resolution services have been provided by Mr. Gallagher on projects ranging in value from $500,000 to $1.5 billion on which various contracting vehicles were employed, including fixed-price, unit price, cost reimbursement and guaranteed maximum price; and issued under traditional design-bid-build, design-build; engineering, procurement construction (EPC); and public-private partnership (P3) procurement methods.
Claims services has been provided on projects of varying size and type, working with both the private and public sectors, involving projects worldwide and ranging from $50,000 to $300 million. Contract compliance audit services have been provided on projects ranging in value from $50 million to $1.5 billion, and included assistance to public and private clients in the recovery of costs that were not necessarily incurred in the performance of the work or reimbursable under the contract.
Mr. Gallagher has provided expert witness testimony on a number of cases including at arbitration and trial, and is experienced in settlement discussions, mediation and dispute review boards. Mr. Gallagher has also been delivering presentations and training seminars for the past 20 years to professional organizations, companies and groups on topics such as project delivery systems, project management, change order management, differing site conditions, loss of productivity, minimizing and managing risks and disputes, and construction schedule methodologies.
Mr. Gallagher is currently serving on the AGC-NASFA Construction Management at Risk (CMAR) Taskforce, the AGC-NASFA Liaison Group Committee, is Chairman of the Transportation & Development Institute’s (T&DI) Highway Construction Committee and a Member of T&DI’s Infrastructure Systems Committee; and a Member of the Committee on Contract Law for the Transportation Research Board (TRB).
